Terms of Service
These Terms of Service ("Terms") are an agreement between MyDentalBoost LLC, a California limited liability company ("MyDentalBoost," "we," "us"), and the business or individual using our services ("you," "Customer"). By creating an account, saving a site, subscribing, or otherwise using mydentalboost.com or any site-building, hosting, or related service we provide (collectively, the "Service"), you agree to these Terms.
1. The Service
MyDentalBoost provides website creation, editing, hosting, and related tools for dental practices, including previews generated from publicly available business information, a site editor, subdomain hosting, optional managed domain registration, and optional email configuration assistance. The Service is for business use by persons 18 or older with authority to act for the practice they represent.
2. Accounts, Collaborators, and Roles
You are responsible for your account credentials and for activity under your account. A site has one admin (owner) and may have up to three invited collaborators. Collaborators may edit the site and may complete a subscription purchase for it; only the admin may manage collaborators and roles, change the site's address, or manage billing and cancellation after activation. The admin may transfer the admin role to a collaborator. Edit invitations are personal to the invited email address.
3. Previews, Name Reservations, and Subdomains
Building and editing a preview site is free and requires no payment method. When you save a site, you may select a site address (a subdomain of a domain we control, e.g., yourpractice.mydb.dental). Saving reserves that address for 14 days; if the site is not activated within that period, the reservation may be released. Subdomains are licensed, not sold. All subdomains remain our property and we may reclaim, reassign, or release any subdomain at our reasonable discretion, including any subdomain that references a business it does not represent. Preview sites may display placeholder content clearly marked as illustrative.
4. Subscriptions, Trial, and Billing
- Plan and pricing. Our current plan and pricing are published on our website. Our standard rate is $289/month; during our grand-opening period, new subscriptions are offered at $129/month for the first 12 paid monthly billing periods, after which the subscription continues at the then-current published standard rate. Canceling, allowing the trial to lapse, or otherwise ending the subscription forfeits the introductory rate; a later reactivation uses the then-current standard rate. Any setup fee is as displayed at checkout (currently waived during the grand opening).
- Free trial. New subscriptions begin with a 30-day free trial starting at activation (when a payment method is added). A valid payment method is required to activate. Unless you cancel before the trial ends, your payment method will be automatically charged the subscription fee on the first day after the trial and monthly thereafter. The exact first-charge date is displayed before you activate.
- 72-hour refund. If you are charged your first subscription payment and did not intend to continue, you may obtain a full refund of that first charge within 72 hours of the charge, self-service from your dashboard, no questions asked. Other than this and where required by law, subscription fees are non-refundable; canceling stops future charges but does not refund the current period.
- Cancellation. You may cancel at any time in one click from your dashboard. On cancellation, your subscription and site access continue through the end of the paid billing period, after which the site is unpublished.
- Price changes. We will not change your rate during your first 12 paid monthly billing periods. Afterward, the then-current published rate applies; we will provide reasonable advance notice of any change to published pricing.
- Payment processing is handled by Stripe; we do not store full card numbers.
5. Domains
- Your own domain. You may connect a domain you already own at any time at no charge. It remains entirely yours.
- Managed domains. If you ask us to register a domain for you: (a) a $20 deposit is charged at registration and is credited in full against your first subscription invoice — your free trial remains free; (b) the domain is registered in your practice's name as registrant, with MyDentalBoost as the technical/management contact while you subscribe; (c) if you cancel, we will transfer the domain to you upon request, subject to a $99 domain release fee, which is waived if you have been a paying subscriber for 12 months or more (registrar transfer-in charges at your new provider are your responsibility); (d) domain registration renewals during your subscription are included in your plan.
- Email. Where we assist with email forwarding or Google Workspace setup, Google Workspace accounts are created in your name and billed by Google directly to you; they are yours and are unaffected by cancellation other than DNS changes accompanying a domain transfer.
6. Your Content
You retain all ownership of the content you provide or create on your site (text, photos, logos, practice information) ("Customer Content"). You grant us a non-exclusive license to host, store, display, reproduce, and technically process Customer Content solely to provide the Service. You are responsible for having the rights to everything you upload and for the accuracy of your practice information. Upon termination, your site is unpublished; you retain your original materials. We may retain copies as needed for backups, legal compliance, and internal records.
7. Acceptable Use
You agree not to: use the Service for anything unlawful, deceptive, or infringing; misrepresent a business or impersonate another practice; upload malicious code; scrape or disrupt the Service; reserve subdomains in bad faith; or publish content you lack rights to. Patient reviews and testimonials displayed on your site must be genuine. We may suspend or terminate accounts that violate this section.
8. Health Information
The Service is a website platform, not a healthcare service, medical record system, or HIPAA business associate, and no Business Associate Agreement is offered or implied. Site forms are designed to collect basic contact information (such as name, phone, email, and preferred appointment time) and display a notice instructing visitors not to include health information. You agree to use forms only for such contact information, not to solicit or collect protected health information through the Service, and to handle any information a visitor nonetheless submits in accordance with your own legal obligations.
9. Third-Party Services
The Service interoperates with third-party services (including Stripe, Google APIs and Google Workspace, Cloudflare, and email delivery providers). Their services are governed by their own terms, and we are not responsible for third-party services.
10. Service Availability; Changes
We work to keep the Service available and performant but do not guarantee uninterrupted availability. We may improve, modify, or discontinue features; if we discontinue the Service materially, we will provide reasonable notice to active subscribers.
11. Our Intellectual Property; Feedback
The Service — including our software, templates, designs, and branding — is our property or that of our licensors. These Terms grant you no rights in it except the right to use the Service. If you send us feedback or suggestions, we may use them without obligation.
12. Termination
You may stop using the Service and cancel at any time (Section 4). We may suspend or terminate your access for material breach of these Terms (including non-payment or Acceptable Use violations), with notice where practicable. Sections that by their nature should survive (including 6–8 and 13–16) survive termination.
13. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE ANY PARTICULAR BUSINESS RESULTS, SEARCH RANKINGS, OR PATIENT VOLUME.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY IS LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS OR DATA; AND OUR TOTAL LIABILITY ARISING OUT OF THE SERVICE IS LIMITED TO THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM. THESE LIMITS DO NOT APPLY WHERE PROHIBITED BY LAW.
15. Indemnification
You will defend and indemnify MyDentalBoost against third-party claims arising from your Customer Content, your use of the Service in violation of these Terms, or your violation of law, including claims relating to information visitors submit through your site's forms.
16. Governing Law; Disputes
These Terms are governed by California law. The parties will first attempt to resolve any dispute informally by contacting each other; any dispute not resolved informally will be brought in the state or federal courts located in Santa Clara County, California, and the parties consent to their jurisdiction.
17. Changes to These Terms
We may update these Terms; material changes will be notified by email or in-product notice with reasonable advance effect. Continued use after the effective date constitutes acceptance.
